The status of Female Trafficking in India..



Now as we all know India along with being all diverse in nature ( in the positive manner) and having all religions and all kinds of languages, so many casts etc we cannot deny that India is also diverse ( in the negative manner) it has all sorts of corruption, overpopulation , you will find all sorts of manners in which a woman can be tortured here etc..So as we can clearly see the negative points surely outweigh the positive points..I have always felt obviously being a girl myself that India does not accord the respect to a woman as it should..we celebrated Navratilova just recently which is a festival where we respect and prayer for the blessing of all the nine forms of Durga..and still we treat the woman in our country as if we are just chattel..
One clear form of disrespect of woman in India is the increasing number of Female Trafficking in India..

In India every year there are a large number of girls who are trafficked from countries lie Nepal and Bangladesh..The woman from Nepal are also trafficked in India for the purpose of performing in circuses.. similarly the women from India are trafficked to the middle east..there is also a lot of labor trafficking that exists..here woman as well as children are sent to the countries of Europe and middle - east where they are exploited they face problems of sexual abuse etc..This is something that is very unacceptable in the Indian society..and it is very necessary that we  put a ban on such kind of behavior..

For stopping women trafficking in India the government has come up with a few punishments..
The Government of India prohibits some forms of trafficking for commercial sexual exploitation through the Immoral Trafficking Prevention Act (ITPA). Prescribed penalties under the ITPA — ranging from seven years’ to life imprisonment — are sufficiently stringent and commensurate with those for other grave crimes. India also prohibits bonded and forced labor through the Bonded Labor Abolition Act, the Child Labor Act, and the Juvenile Justice Act.
These laws are ineffectually enforced, however, and their prescribed penalties — a maximum of three years in prison —are not sufficiently stringent. Indian authorities also use Sections 366(A) and 372 of the Indian Penal Code, prohibiting kidnapping and selling minors into prostitution respectively, to arrest traffickers. Penalties under these provisions are a maximum of ten years’ imprisonment and a fine.
But do these different methods enacted by the Government actually put a stop to female trafficking..I guess certainly not.. that's because in the government and the police itself there are many corrupt bastards who not only allow trafficking to take place but actually also have a hand at doing it..
Today there are many NGO'S etc that are trying their best to stop trafficking..but there is a long way to go..if we do not respect the women of our country and just treat them as another entertainment then this horrible offense will never stop..

Is the Reformative Theory of Punishment suitable for a country like India??

As every Indian knows that India today doesn't only have the largest population well lets say it also has the largest crime rate..every day we hear and read cases of rapes, murders, robberies, etc on the T.V or in newspapers.But what we do about it?? NOTHING..We only read the news for the day sympathize with the victim and the next day as the newspaper is kept as waste the news also is treated as waste..All of us know that criminals are like termites they destroy the country right from the roots..and yet in a country like India we
use the minor form of punishment..the punishment based on reformative theory..

Now one will ask what is this Reformative theory that i am talking about and why is that i am making such fuss about it??
Well it's simple the reformative theory is based in the thinking that the adamant and brutal criminal can be reformed and rehabilitation. It's belief is that no human being is born a criminal but the society the economic the environmental factors make him a criminal.according to this theory man is born in society and so he is affected by the society..According to this theory the government should come up with some policies to rehabilitate the criminal and the people of the country should help them in doing so..This theory is also based on Gandhi's saying "Hate sin, not the sinner". According to this theory the criminals should be put behind bars and kept trapped in four walls.the police officials should deal with them on humanitarian grounds and so should the society once their term is over..

Now if one evaluates this theory in general without being a lawyer or criminologist they will still find many flaws..I am a student of law and i can surely say that this form of punishment that our Indian Judicial System is using sucks..First of all today the population of our country is increasing by leaps and bounds..no one has time for themselves forget having time rehabiltating criminals..Also today the Great Government in India is not interested in using funds to help change crime and criminals in India they are more interested in robbing those funds bloody rogues..
Also if we go to evaluate Mr. Gandhi's quote we will realize that his quote sucks it doesn't make any sense at all..It's true and correct that we should hate sin but not the sinner..are you kidding me?? Sin arises only if there is someone to commit it..It just doesn't happen in the air..and the one who commits it is obviously called an sinner..

In my view the most suitable form of punishment that a country like India can follow is the detterant form of punishment..According to this theory a criminal should be given sever punishment..It should cause so mush fear in the mind of a prudent man that he never thinks of committing a crime ever again.
This theory mainly favor punishments like life imprisonment, capital punishment. forfeiting the land of the accused person etc.According to this theory the punishment to the criminal should be given in the open at noon not behind closed walls at dawn..

The main highlights of this theory to say is that the personal revenge if the victim is mat..the victim feels that justice has been done to him/her by the judiciary..Which is not the case in the reformative theory..

Concluding my write-up i would wanna mention this:-
If a country like India has to reduce its crime rate then it has to change its theory of punishment..
